1. General

1.1 Use of the Nativa website, operated by White Field Group LLC, a company registered in the State of Wyoming, USA, whose address is 30 N Gould St Ste R, Sheridan, WY 82801, USA (the "Website" and the "Company," respectively), is subject to the terms set out below (the "Terms" or "Terms of Service").

1.2 Please note that mere use of the Website constitutes your agreement to the Terms of Service in full, and confirms that you have read and understood all of the Terms of Service and that you agree to them without any condition or reservation. If you do not agree to the Terms of Service, in whole or in part, you are requested to immediately stop using the Website.

1.3 Every user of the Website agrees to and accepts the Terms of Service, and agrees that they will have no claim against the Company, or the marketer of the products, or anyone acting on its behalf, other than claims related to a breach of the obligations set out in these Terms of Service.

1.4 These Terms of Service are written in the masculine form for convenience only, and of course also apply to women.

2. Products

2.1 The Company markets and sells its products via the Website, including the Source product (mushroom coffee) and additional products, as applicable, from time to time.

2.2 The Company may change, at any time and at its sole discretion, the content of the Website and the products sold on it. The fact that a particular product was offered for sale on the Website at any given time does not guarantee that it will be offered for sale on the Website in the future. The Company does not undertake to maintain any minimum scope, availability, or range of products.

3. Purchasing Products on the Website

3.1 Subject to the provisions of these Terms, anyone lawfully holding a valid credit card that is accepted in Israel and/or any other country from which the purchase is made may purchase products on the Website, provided they have supplied the details requested during the purchase process. In addition, anyone using additional payment methods offered on the Website (such as PayPal, Apple Pay, Google Pay, Shop Pay, Bit, and additional payment methods as may be offered from time to time) may purchase products on the Website, subject to the terms of service of that payment method and the agreement between the Company and that provider.

3.2 Notwithstanding the above, the Company may decline to allow a particular user to purchase products on the Website — even if that user meets the requirements of Section 3.1 above — for any reason whatsoever, and even if that user has previously ordered products from the Website. Without derogating from the above, the Company may revoke any user's eligibility to conduct transactions on the Website in any of the following cases:

3.3 If, when registering on the Website, the user knowingly provided incorrect details.

3.4 If the user has committed an act or omission that harms or may harm the Website, the Company, or any third parties.

3.5 If the user has used the Website's services to carry out an act that is illegal under any applicable law, or to enable, facilitate, assist, or encourage the commission of such an act.

3.6 If the user has breached the terms of this agreement.

3.7 At the payment stage of any transaction, the Company will, via the payment processing provider it engages, verify the payment method, and the transaction will be approved subject to the approval of the payment processing provider and/or the credit card company. Transactions will not be approved for a credit card that is blocked and/or restricted from use in any way.

4. Shipping Policy

4.1 Delivery of products purchased via the Website may be subject to a shipping fee. The amount of the shipping fee, if applicable, will be detailed on the order page before the purchase is completed.

4.2 The Company will arrange for delivery of the product purchased on the Website to the address entered by the customer. The estimated delivery time will be detailed on the Website and/or the order page, and may vary depending on the shipping destination (including international shipments), the time of year, holidays, and order volume.

4.3 It is clarified that the Company shall not be responsible for delays resulting from incorrect details provided by the user, and/or the user's failure to respond in order to facilitate delivery, and/or delays resulting from an act, omission, or any other reason related to the shipping company and/or customs authorities in the destination country.

4.4 International shipments may be subject to customs duties, taxes, and/or additional charges applicable in the destination country, which shall be borne solely by the customer and are not included in the product price or shipping price, unless stated otherwise on the Website.

4.5 In areas with restricted access for security and/or logistical reasons, the Company will be entitled to make products available to customers at a suitable nearby location, to be coordinated with them in advance.

4.6 The customer may authorize the courier to leave the shipped products outside their door or at another reasonable location at their place of residence (such as with a neighbor or in a designated locker). If the customer authorizes leaving the products in this manner, sole responsibility shall rest with the customer, and the customer shall have no claim or demand against the Company regarding the delivery of the products, including their presence, theft, quality, characteristics, and so forth.

5. Changes and Cancellations

5.1 A customer who has purchased a product on the Company's Website may cancel the transaction subject to the terms set out below and subject to any applicable law, including, to the extent applicable to the transaction, the Israeli Consumer Protection Law, 1981, and the regulations enacted thereunder (the "Consumer Protection Law"), with respect to customers placing orders from Israel.

5.2 A customer may cancel a transaction within 14 days of receiving the product, provided that the product is returned undamaged, unused, and with its original packaging unopened. The details and method for returning the product will be provided by the Company's customer service upon contact, and may include a return shipping cost to be borne by the customer, subject to applicable law.

5.3 A customer wishing to cancel a transaction, including before receiving the product purchased, may send a cancellation notice by email to: support@nativaearth.com, or by contacting our customer service via WhatsApp at 053-564-6986. The cancellation notice shall include at least the customer's full name, phone number, and order number.

5.4 A customer who has cancelled a transaction in accordance with the provisions of this section will receive a full refund of the amount paid (less a cancellation fee, if applicable under law) directly to the payment method used for the transaction, within a reasonable time and in any event no later than required under applicable law.

5.5 It is clarified that if a customer has not properly completed their order, including due to missing details in the order, such as failure to enter a name and/or payment method details, the Company may cancel the order, at its sole discretion.

5.6 Shipment inspection: The customer is required to inspect the contents of the shipment upon receipt and verify that it matches the order and invoice. A customer who has received a defective product, or a product that does not match the details provided at the time of order, is requested to report this to customer service as soon as possible after receiving the order. Subject to the return of the defective or incorrect product, the Company will arrange to supply the customer with a proper and suitable product and/or a refund, at its own expense.

6. Prices

6.1 All prices listed on the Nativa Website are displayed in the relevant currency as shown on the Website according to the customer's country (including New Israeli Shekels for customers in Israel), and include applicable taxes and/or shipping fees, in accordance with the policy detailed on the order page and in Section 4 above, unless stated otherwise.

6.2 The Company may change the prices of the products offered on the Website at any time, at its sole discretion and without the need for prior notice.

7. Promotions and Discounts

7.1 At its sole discretion, the Company may, from time to time, offer its customers promotions and/or discounts on its products, whether on an ongoing or temporary basis, subject to the terms published on the Website with respect to each such promotion.

8. Payment Methods

8.1 The Website accepts payment via valid credit cards issued by one of the recognized credit card companies, as long as they permit payments over the internet and subject to the type of credit card in your possession. In addition, the Website accepts payment via additional payment methods, such as PayPal, Apple Pay, Google Pay, Shop Pay, Bit, and additional methods as may be displayed on the Website at the time the order is placed.

8.2 Payment processing on the Website is carried out via external payment processing provider(s) (including, among others, HYP, subject to its terms of use and privacy policy), to which payment method details are transferred directly solely for the purpose of completing the transaction. The Company does not retain or process credit card details beyond what is required to complete the purchase.

8.3 The Company reserves the right to discontinue the use of any payment method on the Website, to permit the use of additional payment methods, and to apply different payment arrangements to the types of credit cards or payment methods accepted by the Website.

9. Payment Terms and Dates

9.1 Payment terms and dates shall be in accordance with the Company's decision. Payment dates and the possible number of installments, as applicable, will be presented for your approval when confirming the order.

10. Reviews and User Content

10.1 The Company may contact its customers to request that they leave a review regarding the product(s) they purchased, including via an email sent following a purchase.

10.2 The customer may choose, at their sole discretion, whether to leave such a review, and may also attach photos and/or video clips to their review.

10.3 It is clarified that the Company may, but is under no obligation to, use the review written by the customer on the Company's social media accounts and/or on the Website and/or on any other platform used by the Company, including any photo and/or video clip attached to the review, all without any time limitation, at its sole discretion, and without this entitling the customer to any compensation whatsoever. Writing a review by the customer constitutes acknowledgment and acceptance of all the terms set out above.

11.1 The Company respects the privacy of its users and is committed to protecting the personal information users share with it. We believe users have the right to know our policy regarding the collection and use of information received by us while using the Website. The policy governing the collection of information of all kinds is described in our Privacy Policy, published on the Website, and constitutes an integral part of these Terms of Service. You agree and confirm that the Company may use personal information collected by the Company as part of your use of the Website in accordance with the Privacy Policy. If you intend to use the Website, you must read and agree to the Privacy Policy before using the Website.

12. Disclosure Regarding the Company's Products

12.1 The information detailed on the Website does not constitute a qualified medical recommendation and is not intended to guide the public or to serve as a recommendation, instruction, or advice for the use of the products and/or for changing or discontinuing any medication, nor does it constitute a representation regarding the efficacy of the products or their properties. The information has not been individually scientifically proven and is not intended to serve as a substitute for individualized medical advice or other professional advice. Pregnant women, breastfeeding women, children, and individuals taking prescription medication are requested to consult a physician before using the products.

12.2 Nothing in the images on this Website constitutes any representation or undertaking regarding the efficacy of the products. Use of the products may lead to different results for different individuals, and users hereby waive any claim, suit, or demand against the Company in this regard. Nativa's products are not medications and are not intended to diagnose, treat, cure, or prevent any disease.

13. Miscellaneous

13.1 The Company does not guarantee or undertake that the Website will operate, or that the services provided on it will be available, at all times without interruptions or malfunctions. The Company shall not be liable for the Website not operating and/or not being accessible for any reason whatsoever, including due to a malfunction or error arising from actions of the Company and/or anyone acting on its behalf.

13.2 Without derogating from what is stated in these Terms, the Company and/or anyone acting on its behalf shall not be liable for any damage caused to a user or any third party arising from the Terms of Service, the Website, the content on the Website, the use of the Website, the inability to use the Website, or any act or omission of the Company and/or its representatives, except in cases where such liability cannot be limited or excluded under applicable law.

13.3 All copyrights and intellectual property rights relating to any publication, content, article, design, application, file, software, and any other material published on this Website or on behalf of the Company belong exclusively to the Company, unless stated otherwise. It is prohibited to copy, distribute, publicly display, transfer to a third party, or make any commercial or non-commercial use, without obtaining the Company's explicit prior written consent. 13.5 If any provision contained in these Terms is determined by a competent authority or court to be unlawful, invalid, or unenforceable, that provision shall be deemed severable from these Terms, and such provision shall not affect the validity and enforceability of any of the remaining provisions of these Terms.

13.6 The user and/or anyone acting on their behalf shall indemnify the Company for any loss, damage, and/or expense, including reasonable attorneys' fees, arising from any claim, lawsuit, or demand made by a third party arising from the user's use of the Website and/or a breach of the Terms by the user and/or anyone acting on their behalf.

13.7 The Company may assign and/or transfer the provisions of these Terms of Service and/or its rights and/or obligations under the Terms, in whole or in part, to third parties at its sole discretion, including in the event of a corporate restructuring, merger, or sale.
